Our terms and conditions
I. ACCEPTANCE OF A SHIPPMENT
1.) Control
There is an insurance for the shipment of the ware.
Also damages are rare, you have to control the package on shipment-damages.
2.) Open the package
You should open the package and control the product before acceptance.
3.) Acceptance
Acceptance of the delivery always with reservation of hidden damages.
4.) Hidden damages
In case of hidden damages, please inform us immediately.
Damages can only in time of 7 days after delivery be maintained.
II. TERMS OF TRADE
1.) Contents of the contract
The following conditions of trade are accepted by the customer.
2.) Conclusion of a contract and return policy
W & O Surftechnik binds himself to deal with the order of the customer as it is described in the following contract. The conditions on the website are the basis of the contract. Writing, printing or calculating mistakes are excepted from the contract.
If there are certain mistakes W & O Surftechnik is allowed to cancel the contract.
3.) Prices and Payment
Retail prices include German value-added tax (VAT/ at present 19%) that must be paid by the costumer. Up to a value of 200,- Euro we charge forwarding costs. Above a value of 200,- Euro the forwarding costs are for free except the forwarding costs for surfboards and other items with a length over 2 mt.. For those we need to make an arrangement, which depends on the place of destination. Usually we charge the price of the forwarding agent.
The customer has the choice between payment in advance or by credit card.
At the latest the customer has to pay the price included the forwarding costs, when he gets the goods.
It is a punishable offence, if the customer does not pay until 30 days after getting the product. If there is such a default the lawful interests are raised.
4.) Shipping
The danger proceeds to the customer as soon as the product has left our company.
5.) Warranty
All items have the warranty the manufacturer gave them. For second hand items we give a warranty of one year.
After receiving the items they need to be checked on obvious defects. If there are certain defects, they need to be reported to W & O Surftechnik within 14 days.
6.) Recantation
You are allowed to withdraw from the contract within two weeks after receiving the items without telling a reason for your decision. Withdrawal can be made by post, fax, e-mail or by sending the item back. The customer obliged himself to send the items back within 2 weeks after using the right of withdrawing.
7.) Property-Proviso
Until the complete payment of all claims against the customer the items belong to W & O Surftechnik.
8.) Disputes
If a part, provision, or clause of the terms and conditions of sale, or the application is held invalid, void or unenforceable, such holding shall not affect and shall leave valid all other parts, provisions, clauses or applications of the terms and conditions remaining, and to this end, the terms and conditions shall be treated as severable.
9.) Useable law and court of jurisdiction
There is only the German law valid. Court of jurisdiction in case of claims referring to business connection is Münster.
